Welcome to Toxic or Nah. By using the app you agree to these Terms. The service is operated by Alessandro Tramontin, Via Giuseppe Garibaldi 19, Ponte nelle Alpi (BL) 32014, Italy.

1. What the app does

Toxic or Nah analyzes chat screenshots you upload and provides an interpretation of the relationship dynamics. The analysis is generated by AI (Google Gemini) and is for entertainment and self-reflection purposes only. It is not professional advice, a diagnosis, or a substitute for therapy, counseling, medical advice, or legal counsel. We are not licensed therapists, counselors, or medical professionals.

2. Eligibility

You must be at least 18 years old to use the app. By using Toxic or Nah you represent that you meet this age requirement.

3. Your responsibilities

• Only upload chat content that involves you or that you have permission to analyze.
• Do not upload illegal content, content involving minors in any sexual or inappropriate context, or content that violates anyone's privacy or other rights.
• Do not abuse the app: no automated scraping, no reselling of analyses, no attempts to manipulate or jailbreak the AI, no harassment of other users.

4. Subscriptions and payments

• Free first analysis. New accounts get one full analysis at no cost.
• Single Unlock ($1.99): unlocks one additional analysis. One-time payment, no auto-renewal.
• Monthly subscription ($4.99 / month): unlimited analyses, charged monthly, auto-renews until cancelled.
• Annual subscription ($39.99 / year, billed yearly): unlimited analyses, includes a 7-day free trial for first-time annual subscribers, auto-renews yearly until cancelled. Equivalent to $3.33 / month.
• Where you pay: on the web through Stripe Checkout; on iOS through Apple In-App Purchase and the App Store; on Android through Google Play Billing. The platform you used to purchase is where billing and cancellation are managed.
• Cancellation: from the web go to Settings → Manage Subscription (Stripe Customer Portal). On iOS go to Settings → Subscriptions on your device. On Android go to Play Store → Profile → Payments & subscriptions. Cancellation takes effect at the end of the current billing period; you keep premium access until then.
• Refunds — EU/EEA/UK: per consumer protection law you have 14 days from first purchase to request a refund, provided the digital content has not yet been consumed in full. The trial period counts as "not consumed" for purposes of this window. Email rafcabana0000@gmail.com.
• Refunds — other regions: refunds for App Store / Play Store purchases follow Apple and Google's own refund policies (request via Apple Support / Google Play Console). For Stripe (web) purchases we evaluate refund requests case-by-case within 30 days of purchase.

5. AI limitations

The AI analysis is generated automatically and may be inaccurate, incomplete, biased, or context-blind. The model has not met the person in your chat, does not know your history, and cannot tell when sarcasm, in-jokes, or cultural context flip the meaning of a message. Do not make consequential life decisions — ending a relationship, confronting someone, taking legal action — based solely on the app. Use it as one input among many. If you are in danger or considering self-harm, please contact local emergency services or a crisis hotline.

6. Account termination

We may suspend or delete accounts that violate these Terms (especially the responsibilities in Section 3). You may delete your account at any time from Settings → Privacy & Data → Delete My Account, which permanently removes your stored chats, analyses, and personal data.

7. Intellectual property

The app, its design, brand, AI prompts, the Soul Type framework, and the code are owned by us. You retain ownership of your uploaded screenshots and you grant us a limited, revocable license to process them only as needed to deliver the analysis to you.

8. Disclaimer of warranties

The app is provided "as is" and "as available", without warranties of any kind, express or implied. We do not guarantee uninterrupted service, freedom from errors, or that the analysis will be accurate.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim related to the app is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or incidental damages.

10. Changes to these Terms

We may update these Terms as the product evolves. Material changes will be communicated through the app and, where you have an account, by email. Continued use after a change constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of Italy. Disputes will be resolved in the competent courts of Milan, Italy. Nothing in this section limits non-waivable consumer rights you have under your local law.
